INTRODUCTION AND SCOPE
Trip Jack Private Limited (“TripJack”, “we”, “us” or “our”) is a premier travel platform that empowers travel agents, tour operators, and related service providers with a range of online tools and travel-related offerings (the “Services”) through the website - www.tripjack.com, or any other domains/sub-domains operated by TripJack (“Website”, or “Platform”).
In these Terms and Conditions, the terms “you”, “your”, or “User” refer to any individual or entity that accesses the TripJack website, whether as a casual visitor or by registering for access to our Services. Please note that certain areas of the Website may be available exclusively to registered users.
These Services enable you to access travel information, check the availability of various travel products, and book arrangements—including flight reservations, hotel accommodations, train ticket reservations, holiday packages, cruise tickets, travel assistance services, and visa-related services (collectively, "Travel Products"). Please note that all Travel Products are offered by our trusted third-party partners ("Partners").
These terms (“Terms and Conditions”) apply to all Services on our Platform. Additionally, when you book a Travel Product, your booking is also subject to the relevant Partner’s terms and conditions (such as those of an airline, hotel, travel assistance service provider). Additional terms—like cancellation or change policies—may apply to different Travel Products and will be shown during your booking process, so please read them carefully. These terms also set the rules for using our Website, including guidelines for uploading content, linking to, or interacting with our Website. By using our Website, registering or completing a booking, you agree to these terms and any applicable Partner’s terms.
If you are accessing our Website or agreeing to these Terms and Conditions on behalf of a company, organization, or any other legal entity, you confirm that you have the authority to bind that entity to these Terms and Conditions and that the entity agrees to be bound by them. Similarly, if you are acting in your personal capacity, you represent that you are at least 18 years of age and have the capacity to enter into a legally binding agreement.
PERMITTED USE OF THE WEBSITE
Subject to your compliance with these Terms and Conditions, we grant you permission to access our Website and use our Services to:
promote, market, and advertise Travel Products and Services on your website or at your merchant locations;
manage bookings and purchases for your customers;
provide your customers with all relevant travel information—including details on ticket availability, pricing, travel conditions, and other pertinent information; and
issue tickets and any corresponding documentation provided by us.
You further acknowledge that you will access the Website and avail our Services only for lawful purposes. Without limitation, you agree that when using our Website and Services, you will not:
Copy, disassemble, decompile, or otherwise modify any of TripJack’s Services or the content on our Website;
Grant access to any third party—except as permitted above for serving your customers—or from lease, time-share, lend, rent, or sublicense these Services or any part thereof;
Use them in any manner that violates local, national, or international laws or regulations;
Engage in any activity that is fraudulent, unauthorized, or abusive, or that produces such effects;
Use our Website or Services to harm, or attempt to harm, minors in any way;
Send, knowingly receive, upload, download, or reuse any material that fails to meet our content standards (See section 3 Below);
Transmit or facilitate the transmission of unsolicited or unauthorized advertising, promotional material, or similar solicitations (i.e., spam); or
Knowingly transmit, send, or upload data or material containing harmful code—such as viruses, Trojan horses, worms, time bombs, keyloggers, spyware, adware, or any similar software—designed to damage or disrupt computer systems.
CONTENT STANDARDS FOR CONTRIBUTIONS
These content standards apply to all information you submit or upload to our Website (“Contributions”), including information about yourself and/or your company, passenger details, booking notes, documentation, and correspondence. They must be followed in both letter and spirit, applying to every part of your Contribution as well as to its entirety. We reserve the right, in our sole discretion, to determine whether a Contribution meets these standards.
You must ensure that any Contribution is relevant, accurate, genuine, and legally compliant. You further agree that you shall not submit or upload any Contribution that:
Contains defamatory, hateful, or inflammatory language.
Includes obscene, offensive, or sexually explicit material.
Advocates or glorifies violence or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
Infringes on any intellectual property rights, including copyrights, trademarks, or database rights.
Obscures, deletes or removes any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.
Falsifies the origin or source of software or Contributions contained in a file that is uploaded.
Misleads or deceives or has the potential to confuse or misinform the reader.
Violates any legal or contractual obligations or breaches confidentiality agreements.
Promotes or encourages any unlawful or criminal activity.
Includes unauthorized advertising, promotional material, or irrelevant external links.
Inappropriately and without permission discloses personal or sensitive information, especially regarding passengers, in a way that violates privacy or data protection laws.
Impersonates any person or misrepresents your identity or affiliation.
OWNERSHIP AND INTELLECTUAL PROPERTY
TripJack owns or is duly licensed for all intellectual property rights in relation to the content available on the Website and the Services including but not limited to, text, images, graphics, logos, icons, audio, video, software, data, reports, deliverables, documents, and any other materials. This includes, but is not limited to, patents, copyrights, trademarks, business names, domain names, designs, and database rights—whether registered or unregistered. All such rights are expressly reserved.
Further, any proprietary logos, service marks, or trademarks displayed on the Website remain the property of TripJack or their respective owners. Your use of the Website or the Services therein does not grant you any rights to use these marks except as expressly permitted under these Terms and Conditions.
In connection with your use of the Website and Services, certain deliverables—including but not limited to reports, ticket formats, and other similar materials ("Deliverables")—may be generated or provided to you. Subject to your compliance with these Terms, TripJack grants you a perpetual, non-exclusive, non-transferable license to use such Deliverables solely for your internal use in relation to the Services provided by TripJack. You may not use the Deliverables for any other purpose. All rights in the Deliverables that are not expressly licensed to you remain reserved by TripJack.
Some content on the Website is provided by third parties under license. You have no rights to use such third-party content beyond the permissions granted in respect thereof under these Terms and Conditions. Any use of third-party content outside of these parameters is strictly prohibited. If TripJack, in its capacity as the duly licensed entity for third-party intellectual property rights, determines that you have infringed any such rights, we reserve the right to pursue all available legal remedies, including prosecution to the fullest extent permitted by law.
The Website may contain links to external sites and resources provided by third parties. These links are offered for your convenience and informational purposes only; they do not constitute an endorsement of or control over the linked sites. Your use of any third-party site is subject to that site’s own terms and conditions.
LIMITATION OF WARRANTY AND LIABILITY
TripJack provides its Website and Services on an “as is” and “as available” basis without any express or implied warranties. By accessing our Website and using our Services, you acknowledge that our Platform merely provides a technology interface, and that the ultimate contractual relationship is established directly between you and the Partners. You acknowledge and agree to the following:
The content on our Website may contain technical inaccuracies, typographical errors, or omissions, and may be subject to change or improvement at any time without notice. We do not warrant the accuracy, reliability, or completeness of such content.
Internet transmissions are never completely reliable, private or secure. TripJack disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the functions of the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website or its servers are free of viruses or other harmful components. Although we strive for your satisfaction, you use the Website and Services at your own risk.
The content on the Website in relation to the Travel Products are provided by third-party service providers such as airlines, hotels, and tour operators. TripJack does not warrant or guarantee the correctness, accuracy, or reliability of such third-party content. Furthermore, TripJack acts solely as an intermediary in facilitating travel arrangements and is not the direct provider of Travel Products. We accept no responsibility for any deficiencies or failures in the services provided by third parties in relation to such Travel Products.
Your access to and use of the Website may be affected by circumstances beyond our control, such as interruptions in internet or telecommunications services, maintenance, or other unforeseen events. We are not liable for any loss or damage resulting from such factors.
The Travel Products and Services may not be available in your geographical location or may be subject to change without notice. It is your responsibility to verify the availability and details of these Travel Products and Services with our representative.
TripJack reserves the exclusive right, at its sole discretion, to add, change, suspend, or discontinue any content, features, or portions of the Website or Services at any time without notice or liability. We also reserve the right to deny any User access to the Website or any part thereof.
It is essential that you verify all travel-related information by consulting with TripJack before making any bookings or travel arrangements, as details such as pricing and availability are subject to change without notice.
You acknowledge that travel to certain international destinations may involve increased risks, including security, political instability, health hazards, or other adverse conditions, and that any travel to such destinations is entirely at your own risk regarding both cost and consequences. It is your responsibility to consult with local authorities and review any travel warnings, advisories, or restrictions issued by them before booking travel to these locations. TripJack does not warrant or represent that travel to any specific destination is advisable or without risk, and we expressly disclaim any liability for damages, losses, or delays arising from issues such as improper documentation for entry, exit, or length of stay, or any other travel-related complications at high-risk destinations.
In no event shall TripJack be liable for any direct, indirect, incidental, punitive, remote or consequential damages of any kind arising from your use of, or inability to use, the Website or Services. This limitation applies regardless of the cause, including but not limited to errors, omissions, or interruptions due to circumstances beyond our reasonable control, such as acts of God, government actions, war, civil disturbances, severe weather, or technical failures.
To the fullest extent permitted by law, TripJack’s aggregate liability for any claims arising out of or relating to your use of the Website or Services, including those related to international travel risks, shall be limited to a maximum of Rs. 1000 (Rupees One Thousand only). This liability cap applies regardless of the legal theory under which any claim is brought, whether in contract, tort, negligence, strict liability, or otherwise.
INDEMNITY
You agree to indemnify, defend, and hold TripJack, along with its affiliates, subsidiaries, officers, directors, employees, agents, and licensors, harmless from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or in connection with your use of the Website and Services. This indemnification covers, without limitation, claims or demands arising from:
Any failure, error, or deficiency in the travel products or services provided by TripJack’s Partners or by you to customers. This includes any disputes or claims arising from misrepresentations, non-performance, or defective services related to travel bookings.
Any claim related to a breach of customer privacy or data protection obligations, including unauthorized disclosure or misuse of personal or sensitive data information.
Any breach of these Terms and Conditions by you, including failure to comply with applicable laws, rules, or regulations.
Any errors, omissions, or negligence on your part, or your failure to exercise due diligence in connection with the use of the Website and Services, including in the procurement, booking, or distribution of travel products.
CONFIDENTIALITY AND PUBLICITY
For the purposes of these Terms, “Confidential Information” means any non-public information disclosed by one party (“Disclosing Party”) to the other (“Receiving Party”), whether orally, in writing, electronically, or by any other means. This includes, but is not limited to, passwords, dashboard content, supplier details, travel product data, financial information, identity-related information, and any other information that is designated as confidential or should reasonably be understood as confidential.
The Receiving Party agrees to:
Maintain the confidentiality of all Confidential Information and to use at least the same degree of care as it uses for its own confidential information, but in no event less than a reasonable standard of care.
Use the Confidential Information solely for the purpose of performing its obligations under these Terms and Conditions or to receive the benefits of the Services.
Not disclose any Confidential Information to any third party without the prior written consent of the Disclosing Party, except as expressly permitted herein or as required by law.
Confidential Information does not include information that:
Is or becomes publicly known through no breach of these Terms and Conditions by the Receiving Party.
Was already in the Receiving Party’s lawful possession before disclosure by the Disclosing Party.
Is lawfully obtained by the Receiving Party from a third party without breach of any confidentiality obligation.
Is independently developed by the Receiving Party without reference to or use of the Disclosing Party’s Confidential Information.
If the Receiving Party is required by law, regulation, or court order to disclose any Confidential Information, it shall, to the extent permitted by law, provide prompt written notice to the Disclosing Party so that the Disclosing Party may seek a protective order or other appropriate remedy. The Receiving Party will only disclose the minimum portion of Confidential Information legally required and will use all reasonable efforts to maintain the confidentiality of the disclosed information.
The obligations set forth in this Confidentiality clause shall survive the termination or expiration of these Terms and Conditions and continue for as long as the Confidential Information remains confidential, but in no event less than five (5) years.
Upon termination of these Terms and Conditions or upon the Disclosing Party’s written request, the Receiving Party shall promptly return or destroy all copies of the Confidential Information in its possession, unless retention is required by applicable law.
Nothing in these Terms and Conditions shall be construed as granting any rights, by license or otherwise, in or to any Confidential Information disclosed under these Terms and Conditions.
Both parties acknowledge that any unauthorized disclosure or use of Confidential Information may cause irreparable harm for which monetary damages may be insufficient. Accordingly, the Disclosing Party shall be entitled to seek injunctive relief, in addition to any other remedies available in law or in equity, to enforce the provisions of this Confidentiality clause.
Notwithstanding anything to the contrary in this section, when you register on the Website, you will be required to create a password to access your account. You are solely responsible for maintaining the confidentiality of your password and account, as well as for all activities that occur under your account. You agree to notify TripJack immediately in writing if you become aware of any unauthorized use of your password or account, or any other breach of security. TripJack shall not be liable for any loss or damage incurred as a result of unauthorized use of your password or account, whether or not such unauthorized use occurs with or without your knowledge. Additionally, you agree not to use any account belonging to another person at any time.
MODIFICATION
These Terms and Conditions, together with any Partner-specific terms and conditions and any additional terms governing promotions, contests, or other special features on the TripJack Platform as communicated from time to time, constitute the entire agreement between you and TripJack with respect to the subject matter herein. This comprehensive agreement supersedes all prior understandings, communications, or agreements—whether oral or written—that relate to such subject matter. You may not unilaterally waive, amend, or modify any part of this agreement. TripJack reserves the right to modify, amend, or update these Terms and Conditions and any related documents at any time without prior notice. The latest version of the complete agreement is always available on the TripJack website and any associated partner or promotional platforms, and it is your responsibility to review and familiarize yourself with the most current terms.
GRIEVANCE REDRESSAL
If you have any grievance, complaint, or issue regarding our Website, Services, or these Terms and Conditions, please contact us through the designated channels provided on our "Contact Us" page at https://tripjack.com/nav/contactus. Upon receipt of your grievance, we will acknowledge it and take appropriate steps to address and resolve the issue within the timeframe mandated by applicable law.
TripJack is committed to ensuring that all grievances are handled in a timely and efficient manner.
In the event of any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, the Website, or the Services that remains unresolved, such dispute shall be resolved through binding arbitration as follows:
The dispute shall be submitted to final and binding arbitration under the Indian Arbitration and Conciliation Act, 1996, or any statutory amendment or re-enactment thereof. The arbitration shall be conducted by a single arbitrator, unless the parties mutually agree otherwise, and in accordance with the arbitration rules selected by the arbitrator or agreed upon by the parties.
The seat of arbitration shall be Mumbai, India, and the arbitration proceedings shall be conducted in Mumbai. The language of arbitration shall be English.
GOVERNING LAW:
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws provisions. All disputes shall be resolved in the courts of appropriate jurisdiction in Mumbai.
GENERAL BOOKING TERMS APPLICABLE TO ALL TRAVEL PRODUCTS
These Terms and Conditions govern the process for booking Travel Products on the TripJack Platform. By registering and using the Platform, you agree to be bound by these Terms and Conditions. You represent and warrant you have the necessary authority, whether implied or express, from your customers and the traveller to purchase air tickets, train tickets, booking of hotels, and other products and Services offered on Trip Jack’s Platform. You will inform the customers about the charges, benefits and the Terms and Conditions before making any booking.
REGISTRATION AND ACCOUNT SETUP
You must register as a travel agent on the TripJack Platform by visiting https://tripjack.com/nav/proprietor_register. If you require assistance, please submit your contact information via the inquiry page at https://tripjack.com/nav/b2b-portal-for-travel-agents and we will help you with the onboarding process.
During registration, you are required to provide accurate, complete, and up-to-date personal and professional information. You will secure access to your account with a password, and you are solely responsible for maintaining the confidentiality of your account credentials.
BOOKING PROCESS
You may book Travel Products through the Platform or any designated channels as permitted by TripJack. You must ensure that all details provided during the booking process—including your name, identification, contact, payment details, and travel dates—are accurate. If you identify an error, notify us immediately; however, please note that changes, especially those involving identity, may not be accepted by the Partner.
When booking a Travel Product, you must not:
Use an invalid bank card or an account for which you are not authorized.
Impersonate any individual or misrepresent your identity or affiliation.
Violate any applicable laws, regulations, or regulatory requirements.
AVAILABILITY AND VERIFICATION:
All bookings are subject to availability at the time of booking. TripJack cannot guarantee that every advertised Travel Product will remain available when you book. If a Travel Product becomes unavailable after you have booked, we will notify you as soon as possible.
TripJack reserves the right to adjust prices in response to changes in exchange rates, increases in Partner prices, tax hikes, or other factors that affect costs. Rates quoted are applicable only at the time of quoting and may change prior to your travel date or completing your booking (whichever is earlier).
Additionally, TripJack reserves the right to request further information or verifications to confirm your booking. Failure to provide satisfactory details may result in cancellation of your booking, and TripJack is not liable for any loss or cost incurred during this process.
PAYMENT TERMS AND CONDITIONS
Final payment for booking any Travel Product must be made immediately when requested, and no later than prior to the travel date. No travel vouchers or confirmations will be issued until final payment is received at our office. Please note that final payment conditions may vary for specific products (e.g., air, car, hotel, and tour products), and such conditions will be communicated in writing at the time of booking.
By providing your credit card details and accepting these Terms and Conditions, you authorize TripJack to debit funds from your nominated credit card in accordance with the applicable Direct Debit Request Service Agreement. Credit cards are required to secure bookings if travel is within 14 (fourteen) days. Your bank or credit card provider may apply currency conversion fees.
TripJack offers secure payment methods including UPI, credit/debit cards, net banking, Wallets, Gift Cards, and EMI options. Payments must be made exclusively to TripJack’s designated bank accounts. Payments made by cheque or direct deposit do not attract processing fees.
FEES AND ADDITIONAL CHARGES
An automatic card fee will be applied to credit card payments. This fee covers costs associated with processing bookings, including merchant fees, payment processing costs, administrative expenses, IT system maintenance for payment security, and related charges. Payment gateway fees are non-refundable.
Any fees incurred due to chargebacks or disputed charges on your credit card will be charged to you and are non-refundable.
Any Agent Debit Memo (ADM) arising from GDS misuse (including the use of fictitious or duplicate names, duplicate bookings, or booking churning) or from bookings aborted during the hold period will be borne by you.
CHANGES, CANCELLATIONS, AND REFUNDS
Any alterations or cancellations of a Travel Product after your booking has commenced may incur penalties, and there is no refund for unused booking.
All refund requests must be submitted in writing directly to TripJack or by the User only. The customer may not directly raise any refund requests with TripJack.
No refunds will be provided for bookings cancelled due to acts of God, inclement weather or illness; such cases must be processed through your travel insurance.
In cases of duplicate payment for a single transaction, the extra amount will be refunded as a deposit to your TripJack Wallet within 7 (seven) to 10 (ten) working days, subject to receipt of funds from the Partner in TripJack’s bank account.
Additional terms and conditions for visa related services
Genuine Applications and Compliance
The Partner warrants that all visa applications submitted are genuine and assumes full responsibility for all clients, passengers, or travellers. The Partner shall comply with all documentation requirements imposed by the immigration authorities and consulates of the relevant countries.
Indemnification
The Partner irrevocably indemnifies and holds harmless TripJack, its officers, employees, and agents against any costs, charges, claims, or damages arising from passengers failing to comply with the applicable visa terms and conditions when applications are submitted through TripJack.
Visa Application Processing
The Partner consents to TripJack processing visa applications on its behalf. TripJack’s role is limited to receiving applications and required documents, forwarding them to the appropriate consulates and immigration authorities, and communicating application statuses. Visa applications are assessed on their individual merits, and the relevant authorities reserve the right to request additional information or to approve/ deny a visa without providing reasons. The decision to grant or refuse a visa rests solely with the respective immigration departments and consulates; TripJack has no influence over these decisions. Visa fees are non-refundable regardless of the outcome.
Documentation and Verification
The Partner is responsible for verifying the accuracy and completeness of all documents before submission. This includes, but is not limited to, ensuring that passport copies (front and back), photographs, documents for minors, passport observation pages, and any additional forms required by the consulate or immigration authorities are correct. The Partner must also confirm that the correct visa category is selected before sending any requests.
Flight and Boarding Procedures
For the issuance of an “OK to Board” message, the Partner must provide TripJack with the Passenger Name Record (PNR) at least 72 (seventy-two) hours before departure on weekdays and at least 96 (ninety-six) hours before departures on Friday or Saturday. Additionally, the Partner is responsible for reconfirming this message with the airlines at least 24 (twenty-four) hours before departure. TripJack reserves the right to reject any application based on its quality control standards and the passenger’s profile.
Liability and Disclaimers
Both parties agree to all the Terms and Conditions set forth in this agreement. TripJack plays no role in assessing visa applications, which is solely at the discretion of the respective consulates and immigration authorities and is not liable for any delays in processing or visa rejections. Moreover, TripJack is not responsible for any losses or damages incurred by customers due to processing delays, system errors, technical issues, courier problems, or natural calamities. It is also not liable for fines imposed on passengers for criminal offenses or for entry decisions made by immigration officers at the port of entry.
Privacy and Data Security
TripJack will take reasonable measures to safeguard the confidentiality of information provided in visa applications. However, it is not liable for any unauthorized access or data breaches, including those resulting from third-party services or malicious activities. By accessing and using this site, the Partner agrees to comply with the current privacy policy and any applicable terms and conditions of third-party platforms.
Passenger Obligations and Penalties
The Partner guarantees that all passengers will adhere to the flight schedule submitted with the visa application and depart within the visa’s validity period. If any passenger overstays or absconds on a sponsored visa, the Partner shall pay TripJack the penalty imposed by the consulate or immigration authorities within five working days of notification, calculated at the prevailing exchange rate. Additionally, the Partner confirms that no passenger will engage in unauthorized employment or otherwise violate the terms of their sponsored visa (including those for UAE, Oman, Bahrain, Qatar, and other applicable countries). Any penalties imposed by consulates, immigration authorities, suppliers, or local authorities—whether directly or via third-party intermediaries—shall be the sole responsibility of the Partner.
ADDITIONAL TERMS AND CONDITIONS FOR TRAVEL ASSISTANCE SERVICES (TRIPSAFE)
TripJack provides travel assistance services (hereinafter “TripSafe Services”) exclusively in India through its Partners to provide customers extensive coverage for their overseas trips, for protection against key risks such as trip cancellations, medical emergencies, lost or damaged baggage, flight delays, and more. TripSafe Services may include, but are not limited to, emergency travel support and concierge services. The TripSafe Services are provided by Across Assist and are subject to the terms and conditions available at https://www.tripsafe.in/aainternationaltravelassistance.pdf. Customers of TripSafe Services can also avail Comprehensive Travel Insurance (CTI) cover under the Master Insurance Policy issued by Aditya Birla Health Insurance Company Ltd (ABHI). The CTI cover is subject to the terms and conditions mentioned in the Certificate of Insurance issued by ABHI and will be valid only if the origin of the trip is India, all travellers have Indian passports or Overseas Citizenship of India (OCI), and the traveller has an Indian bank account.
